Answers you can trust from a law firm that fights for you

Your car accident may have been over in moments, but the consequences can last a lifetime. It’s normal in the wake of a crash to be confused, overwhelmed and confronted with difficult questions. That’s why we’re here to help. Here are some of the most common questions we’re asked:

Do I need to see a doctor after my car accident?

Yes. Your first step after an accident should be to seek immediate medical attention. Many car accidents result in injuries with delayed-onset symptoms, such as brain injuries and internal injuries. We strongly recommend that you go to an emergency room or urgent care clinic as soon as possible after an accident and follow up with your primary care doctor in a timely manner as well. Follow your doctor’s instructions and keep a journal to track your recovery.

Should I talk to my insurance company after a car accident?

You do need to contact your insurance company in a timely manner and let them know that you were involved in an accident; otherwise, they may deny your claim. During that initial notification, keep your comments brief and stick to the facts of what happened. Don’t say anything that could be construed as admitting fault for the accident. Refer any further questions to your attorney.

What types of compensation can I receive after a car accident?

In general, you can seek compensation for any financial loss that results directly from the injuries you sustained in a car accident. These are called economic damages. Some common examples of economic damages include medical expenses, lost wages, loss of future earnings, home or car modifications, and property damage. You can also seek compensation for other losses called non-economic damages. Common examples of non-economic damages include pain and suffering, loss of enjoyment of life, and emotional distress. In a few cases, you can also seek punitive damages.

Should I accept a settlement offer from the insurance company?

It’s common for insurance companies to offer lowball settlements that do not cover all of your accident-related expenses. They’re hoping that you will take that offer and go away. Remember, once you’ve accepted the insurance company’s money, that’s often it. In most cases, you can’t go back and ask for more money. We recommend hiring a car accident lawyer to better your chances of receiving compensation that will cover all of your accident-related expenses.

What if the driver who hit me doesn’t have insurance?

If the driver who caused your accident doesn’t have insurance, you can file an uninsured motorist claim with your own insurance company if your policy includes uninsured motorist protection (UM). In Indiana, your insurance company is required to offer you this coverage, although you can opt out in writing. In cases where the driver who hits you has insurance, but not enough insurance to pay the full value of your claim, you are protected by underinsured motorist coverage. Again, your insurance company is required to offer you this coverage.

How much will I get paid if I was hit by a car?

Pedestrian accidents often result in severe injuries, sometimes permanently disabling injuries. When a car or truck hits somebody, even at a low speed, the amount of force results in considerable damage. The circumstances of every case is different, so our attorneys know how to find out exactly what happened and hold the negligent motorist who hurt you accountable. We'll determine the full value of your injuries based on the impact the accident has had on your life, and we're prepared to justify every single dollar before a judge and jury.

After an accident, we know what to do

With offices in Fort Wayne and South Bend, we serve accident victims throughout Indiana. And we handle all types of car accident cases, including:

We won't let the insurance company push you around. From the moment you call us until the day your case resolves, we'll stand up for your legal rights and fight hard for your interests. Our attorneys will protect you while you focus on getting better.

We know how to build winning cases after Indiana car accidents

Insurance companies know that people injured in car accidents face an uphill battle, and they take full advantage. You may get a "lowball" settlement offer that doesn't come close to paying for the full cost of your injuries, or your claim may be denied altogether. That's not acceptable, and we know how to fight back. Visit our car accident FAQ page to learn more about how we handle these cases.

We're not interested in a quick settlement. We prepare every case to go to trial, and here in Indiana, that's a tough bar to clear. Hoosier juries don't fall for smoke and mirrors. They want to see the evidence, and we deliver. If we're going to ask for hundreds of thousands or even millions of dollars for your claim, we're prepared to justify every dime with photographs, physical evidence and expert witness testimony. We have strong relationships with accident reconstruction experts, medical professionals, economists and others who can help us prove to a jury the impact that your accident has had on your life.

When the insurance company sees we're prepared to fight hard for the benefits you need, they often agree to a fair settlement. But we're only interested in a settlement that meets your needs, and if the insurance company won't cooperate, we're prepared to take them to trial. Our attorneys have fought for and won multiple six- and seven-figure recoveries for our clients, including $1,750,000 for the family of a woman who died of surgical complications after a trucking accident.

Last year, my wife was in a car accident that was caused by a teen driver who admitted he was texting while driving. Even though this was indicated in the police report, his insurance company refused to pay for the hospital bills that incurred from my wife's injuries. We retained Boughter Sinak to fight for our case and help resolve the issue.

From the first meeting with Robert and Kenny, we were put at ease that their office would handle talking to the insurance company. This was a big stressor and they took care of everything. We appreciated their dedication to our case and the knowledge the provided along the way. This is a great law firm if you find yourself in an injury and needing a skilled Fort Wayne attorney.
